We have to figure out a way of making this system of checks and balances for our government in Iraq. In fact, we can look at the Americans, and improve where they have failed at.

If I may offer an observation from an American, the place where we have failed most is in the Judicial branch.

 

One of the fundamental principles of the American system of government is that it must be a government of Laws not Men. That is to say, no official's word, or opinion, should ever be the law. No *man* can be allowed to make any law. The law must only be made by the People, through their representatives and government institutions.

 

The US Constitution, through its bicameral legislature and three-way split of powers, goes a long way towards ensuring that no Man can make Law. With one important exception: the Courts. As soon as we allowed judges to make new law, by "interpretation", and allowed that law to stand, instead of impeaching the judges as should have been done, we started on the slippery downhill slope to a government of Man, not Law.

 

We have slid far down that slope today. If you look into the things you find as failings in the legal structure of America, I think you will find that the vast majority of them are the result of judges run amok - not bad laws passed by Congress.

 

Let me give you one example. The First Amendment of the US Constitution says:

 

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press..."

 

Note that it says NO LAW. Very plain language. Not "a few" laws, or "reasonable" laws, or laws that "serve an overriding government interest", or laws that conform to some religious sensibility. No. Law.

 

So let's say the government decides it would be a good idea to make a law banning certain speech - perhaps "hate speech". It is the plain duty of the judge to throw out that law, and declare it unconstitutional - after all, that's his job, that's why we HAVE a judicial branch, to prevent the legislature from enacting laws that go against the constitution. But what if he doesn't?

 

What if the judge decides, for whatever reason, that the Law the People wrote, the part where it says "Congress shall make NO LAW..." - doesn't really mean that? What if the judge thinks the new anti-"hate speech" law is a great idea, and doesn't care that it's unconstitutional? What if the judge fails to do his duty to the Law and the People and throw out the plainly illegal "hate speech" law? Then what?

 

Answer, in my opinion, is that you need to more tightly control the judiciary so that they cannot do this sort of thing. Ever. Legal change should only come through the legislative branch. The judicial branch can only say "yes" or "no" - they should not be allowed to say "do this thing we like better".

 

Putting the issue of out-of-control judges aside for the moment, the single worst thing about the US Constitution is that it's not clear whether it is a limiting or enabling document. What I mean is, can the government ONLY DO things it is given specific permission to do in the constitution, or can the government do anything NOT SPECIFICALLY PROHIBITED by the constitution? It's a very, very, very, different thing.

 

I'm almost positive the authors of the US Constitution intended it to be an enabling document, that is, the government would only be able to do the things it was specifically allowed to do. But, tragically, the actual wording of the Constitution is rather unclear on this point, and people have been arguing about it for over 200 years - and you can believe, the government has used this uncertainty to greatly increase its powers. Avoid this trap. Write your constitution very firmly so that the government can only do the specific things laid out in the constitution, and can only regulate certain aspects of life. All other rights should be retained by The People. Yeah, that means you, the Iraqi people. You need to be making your own decisions in your own lives, so far as is possible. Keep the government wrapped up tight.
